This Privacy Policy describes how our company, Palateable, LLC (“Palateable,” “we,” “us,” or the “Company”), uses the information you provide to us when you access our website (“Site”) or use our service (“Service”). Please read this document carefully- if you provide us with any information, you are acknowledging that you have read and understood this Privacy Policy and agree to be legally bound by it. If you do not agree with the terms of this Privacy Policy, please refrain from using our Site.
We are committed to maintaining the privacy of information that you might share with us while visiting our Site. This privacy policy discusses how we collect, use, and treat personal information that visitors (“Users”) may provide to us through our site.
If you submit any information or order any products via our Site, you will be prompted to click an “I Accept” button linked to this Policy. Clicking “I Accept” further confirms your understanding of and agreement to be bound by this Privacy Policy, together with our Terms of Service.
SECTION ONE. Information We Collect
Information we may collect from you includes Personally Identifiable Information and Non-Personal information.
A. Personally Identifiable Information (PII) means any information you provide that can be used to identify you, including your name, telephone number, address, and other contact information. As of the effective date of this Privacy Policy, we collect the following elements of PII from our users:
1. When you contact us: When you complete a contact form on our Site, we collect your name and your email address.
2. When you become a customer: To establish an account, we require you to provide us with your name, email address, full delivery address, phone number, and billing address (if different from delivery address). We also ask for your company name, but you are not required to provide it to use our Service.
3. When you make a purchase: When you make a purchase on our Site, we will collect your credit card information to process your payment. We use Shopify Payments to process payments for one-time orders, and Stripe to process subscription payments. Your credit card information is transferred directly to either Shopify Payments or Stripe and is not stored on our servers. Please see below to review the policies and procedures employed by Shopify and Stripe to protect your payment information.
4. When you log in using Facebook or Google: If you choose to log in to your account through Facebook or Google, you are granting us permission to access and use certain information about you that you choose to include in your social media profile.
5. When you post reviews or comments: If you post a review or comment on our Site, it will be stored on our servers and visible to other Users. To the extent possible, you should avoid including PII when posting such content.
6. When you visit the Site: We also record your computer IP address whenever you visit our Site. Under ordinary circumstances, an IP address recorded in isolation is not PI under the standard definition of the term. However, it may become PI when it is combined with other information.
B. Non-Personal Information is information that does not identify you as an individual. This sort of information includes your IP address, which is automatically collected and recorded in our server logs from your browser, and may also include statistical information concerning, for example, the pages on our website that users visit most frequently. We may collect Non-PII through features of the software that supports our Site, through cookies, which is a type of software used to gather and store visitor information such as unique mobile device identifier, browser type, ISP or carrier name, and the URL of the last webpage visited before visiting our Site.
SECTION TWO: How We Use Information
A. Your PII: We use your name, address, and phone number to process and deliver your orders and to contact you if necessary. We ask for your email address to contact you via email for account and non-account related purposes. You can opt out of receiving non-account related emails at any time by clicking on the “unsubscribe” link included in every email.
B. Non PII: We use Non-Personal Information for our internal business purposes, such as to analyze the effectiveness of certain elements on our Site, and for other purposes. We may therefore share this information with third parties for this purpose. Any information we may share will not include PII.
SECTION THREE: How We May Disclose Information
We will not share PII with third parties for marketing purposes. We may disclose your PII to third parties in the following circumstances:
A. Third Party Vendors: We employ third party vendors to provide certain key functions, and in some cases, must share PII with them to enable them to do so. For example, we will share your name and address with one or more delivery companies we may employ to deliver your order and share your email address with our email service provider. Your PII and Non-PII will be stored on our servers and thus will be shared with our hosting service provider. These third parties are expressly prohibited to use PII for any other purpose, or to retain such information after the requested services are provided. As of the effective date of this Privacy Policy, we share data with the following outside service providers:

B. Legal Purposes: We may disclose your PII on a case-by-case basis in order to comply with court orders, official investigations, and in similar involuntary circumstances. Unless instructed otherwise, we will make every effort to inform you when we have received a request to disclose your PII in this fashion. We may also disclose your PII to protect our own legal rights or those of other users.
C. Asset Transfers: If we choose to sell our business, customer information, including PII, is typically one of the business assets that are transferred. If we enter into bankruptcy, customer information (including PII), would be considered an asset that may acquired by a third party. You acknowledge that such transfers may occur, and that any assets may continue to be used according to your PII as set forth in this policy.
SECTION FOUR: General Policies
A. Security: We use industry standard SSL data encryption and other technologies to protect any data you entrust to us.
B. Underage Users: This Site and the services and products we provide are not intended for children under the age of 13. We do not knowingly collect or maintain PII from children under the age of 13 at our site. If at any point we discover that we unknowingly collected PII from anyone under the age of 13, we will remove such information from our records.
C. For California Residents: California residents are accorded special privacy rights under California Law (California Civil Code Section 1798.83). In addition to the rights set forth in this Privacy Policy, California residents generally have the right to request information from us regarding the manner in which we share certain categories of PII with third parties for their direct marketing purposes. Pursuant to Section 1798.83 of the California Civil Code, Californians may request that a business disclose the types of personal information the it shares with third parties for direct marketing purposes, and the identities of the third parties with whom the business has shared such information during the immediately preceding calendar year. Californians may request information about our compliance with this law by sending an email to help@palateable.com.
D. Do-Not-Track Requests: We employ certain technologies, including Google Analytics, that enables us to track your online activities over time and to a certain extent across third-party Web sites. We currently offer no response to Do-Not-Track requests transmitted by Web browsers, but you may limit tracking by adjusting your browser settings.
E. Your Options: You may cease receiving non-account related emails from us by clicking on the unsubscribe link included in every email. Unless we are required to retain it for legal purposes, if you cancel or cease using your account, we will delete all of your PII at your request. We do not currently offer any other options regarding how we use the information they provide to us.
F. External Links: The Site may include links to other websites whose privacy policies we do not control. Once you leave our site, use of any information you provide is governed by the privacy policy of the operator of the site you are visiting. That policy may differ from ours and is not covered within this privacy policy.
G. Changes to this Privacy Policy: We reserve the right to amend, alter, or otherwise change this Privacy Policy at our sole and absolute discretion. If we make any changes regarding the disclosure of Personal Information to third parties, we will inform Users via a prominent link on our site, and post notice of the new Policy from the privacy link on our Site. Further use of this site following any such change constitutes your agreement to follow and be bound by the amended Privacy Policy.
